Last updated: 02/10/2026
1. Scope of Application
These General Terms and Conditions (hereinafter “AGB”) apply to all orders placed and contracts concluded via the online shop of Swissopia AG (hereinafter “Seller”) by customers (hereinafter “Customer”).
By placing an order, the Customer explicitly accepts these AGB in the version valid at the time of the order. Any terms deviating from, contradicting, or supplementing these AGB shall not be recognized unless expressly agreed to in writing by the Seller.
2. Contracting Party
The contract is concluded with:
- Company Name: Swissopia AG
- Legal Form: AG
- Address: Rhenaniastrasse 9, 8212 Neuhausen, Switzerland
- UID / Corporate Identification Number: CHE-377.814.950
- Email: fva@swissopia.com
3. Offer and Conclusion of Contract
3.1. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to the Customer to place an order.
3.2. By clicking the button [e.g., “Buy Now” / “Place Binding Order”], the Customer submits a binding order for the items in the shopping cart.
3.3. The contract is officially concluded when the Seller accepts the order by sending an order confirmation via email, or by delivering the ordered goods.
4. Prices and Shipping Costs
4.1. All prices listed in the online shop are stated in Swiss Francs (CHF).
4.2. Prices include Swiss statutory Value Added Tax (VAT).
4.3. Any applicable shipping and packaging costs are displayed transparently during the checkout process and are to be borne by the Customer, unless free shipping is explicitly stated.
5. Payment Terms
The Customer can choose from the payment methods available at checkout. The Seller offers the following options:
- Vorauskasse (Advance Payment): The Customer must transfer the full invoice amount to the Seller’s bank account within 3 business days. The goods will only be dispatched after the payment has been successfully cleared.
- TWINT / Stripe (Credit Card, etc.): The payment is processed immediately at checkout. The Customer’s account or card is charged upon completion of the order.
6. Delivery Conditions
6.1. Deliveries are made exclusively to shipping addresses within Switzerland.
6.2. Unless otherwise specified on the product page, the standard delivery time is approximately 2 to 5 business days.
6.3. If delivery becomes impossible due to reasons outside the Seller’s control (e.g., force majeure, supplier delays), the Seller is entitled to withdraw from the contract. In this case, any payments already made by the Customer will be refunded immediately.
7. Retention of Title
The delivered goods remain the sole legal property of the Seller until full payment of the invoice amount has been received.
8. Warranty and Notification of Defects
8.1. The Customer is legally obligated to inspect the delivered goods immediately upon receipt and to report any obvious defects or damage in writing (via email) within3 business days.
8.2. For justified and timely reported defects, the Seller may choose to either replace the defective product, offer a repair, or issue a full or partial refund.
8.3. Normal wear and tear, improper handling, or damage caused by the Customer are strictly excluded from the warranty.
9. Right of Return and Refund Policy
There is no general right of return or exchange for error-free and correctly delivered items. Returns are only accepted in the case of defective goods as outlined in Section 8.
10. Liability
The Seller’s liability is strictly limited to intentional intent and gross negligence in accordance with Article 100 of the Swiss Code of Obligations (OR). Liability for auxiliary persons, indirect damages, or consequential loss (such as loss of profit) is entirely excluded.
11. Data Protection
The collection and processing of the Customer’s personal data are governed by the separate Privacy Policy, which is an integral part of these contractual terms.
12. Severability Clause
Should individual provisions of these AGB be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the original economic intent.
13. Applicable Law and Jurisdiction
13.1. All legal relationships between the Seller and the Customer are governed exclusively by Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2. The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Neuhausen, Switzerland, unless mandatory consumer law dictates a different location.
Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.
